1. Acceptance of Terms

These Terms of Use (the “Terms”) constitute a binding agreement between you and The #NOT62 Coalition (“#NOT62,” “the Campaign,” “we,” “us,” or “our”) governing your access to and use of the website located at not62.vercel.app, including all content, functionality, and services offered on or through it (collectively, the “Site”). By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must discontinue use of the Site.

2. Eligibility

The Site is intended for use by individuals who are at least 13 years of age. By using the Site, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

3. Description of Services

The Site provides information regarding the #NOT62 campaign, including health mitigation media content, governance and meeting documentation, steering committee and partner organization information, a constituent policy suggestion form, and a donation portal (collectively, the “Services”). We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice.

4. Acceptable Use

You agree that you will not, in connection with your use of the Site:

  • Violate any applicable local, state, national, or international law or regulation;
  • Submit false, misleading, fraudulent, or impersonating information through any form on the Site, including the policy suggestion form;
  • Interfere with, disrupt, or attempt to gain unauthorized access to the Site, its servers, or any connected network or system;
  • Use any automated means, including bots, scrapers, or crawlers, to access the Site for purposes other than standard search engine indexing, or to submit content to any form at a volume or frequency inconsistent with ordinary individual use;
  • Transmit any viruses, malware, or other harmful code; or
  • Use the Site to harass, defame, or violate the rights of any third party.

We reserve the right, in our sole discretion, to restrict, suspend, or terminate access to the Site for any user who violates these Terms.

5. User Submissions

Any policy suggestion, comment, or other content you submit through the Site (“User Submissions”) is provided voluntarily and without any expectation of compensation or confidentiality, except as described in our Privacy Policy. By submitting content, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and internally distribute that content for the purpose of reviewing and responding to it and informing campaign policy positions. You represent that any content you submit is accurate and that you have the right to submit it.

6. Donations and Payments

All donations made through the Site are processed by our third-party payment processor, Stripe, Inc., and are subject to Stripe's Services Agreement in addition to these Terms. By submitting a donation, you authorize us, through Stripe, to charge the payment method you provide for the amount and frequency (one-time or recurring monthly) that you select. Recurring monthly donations will continue to be charged on a monthly basis until cancelled; to cancel a recurring donation, contact us using the information in Section 16.

#NOT62 is not currently a registered non-profit organization. Monetary donations and in-kind contributions made through this Site are not tax-deductible.

Donations are voluntary contributions and are generally non-refundable. We may, in our sole discretion, issue a refund in the case of a demonstrable processing error (such as a duplicate or erroneous charge). Refund requests should be directed to the contact information in Section 16.

7. Intellectual Property

Unless otherwise indicated, all content on the Site, including text, graphics, logos, articles, and the compilation and arrangement thereof (the “Content”), is the property of The #NOT62 Coalition or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws. You may view, download, and print Content solely for your personal, non-commercial, informational use, provided you do not remove any copyright or proprietary notices. Any other use of the Content, including reproduction, modification, distribution, or republication for commercial purposes, requires our prior written consent. All third-party trademarks, service marks, and embedded content (including YouTube videos) remain the property of their respective owners.

8. Third-Party Links and Services

The Site may contain links to, or embedded content from, third-party websites and services, including partner organizations and video hosting platforms. Such links and embeds are provided for convenience only. We do not control, endorse, or assume responsibility for the content, accuracy, or practices of any linked third-party site, and your use of any such site is governed by its own terms and policies.

YouTube API Services: The Site and our administrative management systems use YouTube API Services for embedding and publishing video content. By accessing embedded YouTube videos or connecting a YouTube channel through our administrative interface, you agree to be bound by the YouTube Terms of Service and the Google Privacy Policy.

9. Disclaimer of Warranties

THE SITE AND ALL CONTENT, INFORMATION, AND SERVICES PROVIDED THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY INFORMATION PROVIDED ON THE SITE IS CURRENT, COMPLETE, OR ACCURATE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE #NOT62 COALITION, ITS OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to defend, indemnify, and hold harmless The #NOT62 Coalition and its officers, directors, employees, volunteers, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your violation of these Terms or your misuse of the Site.

12. Termination

We reserve the right to suspend or terminate your access to all or part of the Site, at our sole discretion and without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, us, or third parties. Sections of these Terms that by their nature should survive termination (including Sections 7, 9, 10, 11, and 13) shall survive.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in [COUNTY], New York, and you consent to the personal jurisdiction of such courts.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the Site and supersede any prior agreements or understandings, whether written or oral, relating to the subject matter herein.

16. Changes to These Terms

We may revise these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent revision. Your continued use of the Site following the posting of revised Terms constitutes acceptance of those changes.
